2014/S 250-443949 INTERNATIONAL INVITATION FOR TENDERS ROAD REHABILITATION AND CITY BYPASS GOVERNMENT OF MONTENEGRO MINISTRY OF TRANSPORT AND MARITIME AFFAIRS TRAFFIC DIRECTORATE The Government of Montenegro, Ministry of Transport and Maritime Affairs, Traffic Directorate (hereinafter referred to as “the Borrower”) has received a loan from the European Investment Bank – EIB (hereinafter referred to as “the Bank”) – towards the cost of the Road Rehabilitation and City Bypass Project. This International Invitation for Tenders relates to the contract for: Reconstruction of the Main Road M-2.4 Ulcinj – Sukobin, section: Ulcinj – Krute. This contract will include: Road reconstruction, rehabilitation of asphalt pavements, rehabilitation/reconstruction of retaining walls, bridge reconstruction, stabilisation of unstable slopes and tunnel reconstruction. This contract is expected to be implemented within 360 calendar days from the date of the signature of the contract for the works. The estimated value of works amounts EUR 9 million including VAT. The criteria to be used in the tender evaluation are, in decreasing order of importance: the lowest price. All firms are invited to participate in the tender. Conditions for Participation in a Public Procurement Procedure and Evidence on Fulfilment of the Conditions Mandatory conditions for participation in a public bidding In order to participate in a public procurement procedure, the bidder must fulfil the following mandatory conditions: 1) that it was registered for performing the activity which is the subject-matter of the public procurement, as its principal or prevailing activity; 2) that it possesses a valid permit (licence or other act) for performing the activity that is the subject-matter of the public procurement, in accordance with the Law; 3) that it duly paid all its obligations arising from taxes and contributions in accordance with the Law or the regulation of a foreign country if its head office is in that country; 4) that during the period of two years before publication of the contract notice or delivery of invitation to tender it has not been convicted in a criminal proceeding nor subjected to the prohibition of further conduct of business that is related to the felony. The evidence that the conditions referred to in this Section, sub-item 1 to 4 of this form, shall be submitted in the form prescribed in Articles 66 and 74 of the Law on Public Procurement, as follows: 1) evidence on registration from the register of the competent authority; 2) permit, license, approval or other act in accordance with the Law. (In accordance with Article 4, paragraph 2 of the Book of Rules on the methodology of expressing subcriteria into on the method of evaluation and comparison of bids, the Purchaser shall address the competent authority, which will declare that the bidders in a public procurement procedure, are required to submit the following evidence (permits, licenses, approvals or other act in accordance with the law): 1. In accordance with Article 4, paragraph 2 of the Book of Rules on the methodology of expressing subcriteria on the method of evaluation and comparison of bids, the Purchaser addressed to the competent authority: Chamber of Engineers of Montenegro, which with its act No. 01-3800 / 3 of 11 September 2014 declared that the bidders in a public procurement procedure, shall submit the following evidence (permits, licenses, approvals or other act in accordance with the law, etc.): Bidder (group), must provide evidence that they have licenses for: • Construction and building-craft works on traffic structures (the Holder of bid in the case of a joint bid of the consortium); • Construction and construction-craft works on buildings • Construction and building-craft works on hydrotechnic facilities • Execution of Geodetic Works • Execution of geotechnical works 2. In accordance with Article 4, paragraph 2 of the Book of Rules on the methodology of expressing subcriteria into the method of evaluation and comparison of bids, the Purchaser, in part referring to the works of excavation with the use of explosive material, addressed to the competent authority of the Ministry of the Interior Affairs, the Directorate of Emergency Situations, which with its act No. 04-050 / 14-24024 / 2 of 15 May 2014 declared that the bidders in a public procurement procedure are required to submit: • Permission to conduct mining activities. 3) a certificate from the state authority in charge of tax affairs that the bidder duly paid all its obligations arising from taxes and contributions for the period of 90 days before the date of public opening of bids; 4) a certificate, or other act by the competent state authority based on the data from the criminal records. Evidence of the conditions for participation in the procurement procedure shall be submitted in original, certified copy or electronic form in accordance with the invitation to tender, the invitation to tender and the tender documents. Optional conditions for participation in the public bidding 1) Technical and/or professional and staffing abilities (Article 67 of the Law on Public Procurement) (Right and authority of the contracting authority is to determine, in accordance with Articles 69,70 and 71 of the Law on Public Procurement, the type of evidence for the professional technical and human resources capacity) The bidder shall demonstrate the compliance with the conditions related to technical and professional and staffing abilities by providing the following proofs: 1) A list of the works provided over a period of previous five (5) years, together with the terms for works execution including the amounts, dates and location of working site. 2) Statement on educational and professional qualifications of the bidder, that is, the qualifications of the management staff and in particular the qualifications of the persons responsible for providing the services in question; - List of all the expert personnel that bidder intends to engage in the implementation of the contract; - References of expert personnel; Evidence that the persons responsible for managing the execution of the works (chief engineers), are licensed as following: • the chief engineer for the works on the road - the chief engineer to work on the road - a license for the management of performing construction and construction - craft works on objects of traffic (the Holder of bid in case of a joint bid of the consortium) • Engineer responsible for work on reinforced concrete structures - license for implementation management of construction and construction - craft works on buildings • Responsible Engineer of hydrotechnic Works - a license for the management of performing construction and construction - craft works on hydrotechnic facilities • Engineer responsible for Geodetic Works - a license for the management of performing geodetic works • Engineer responsible for geotechnical works - a license for the management of performing geotechnical works Evidence that licenses are valid - the certificate of membership in the Chamber of Engineers of Montenegro. Evidence that the chief engineer and chief engineers are employed by the bidder - a certified copy of the work booklet. 3) a statement of the bidder regarding the annual average number of staff and on the number of persons performing managerial functions in previous three years; 4) a statement on technical equipment at the bidder’s disposal for provision of the services in question; 5) a statement on any intention and subject of subcontracting, or intention to hire the subcontractor. If the bidder fails to submit any of the proofs required by the tender notice and tender documents, the tender will be rejected as invalid.
