2015/S 207-374744 Project name: Railways: Emergency Infrastructure Rehabilitation Project II Country: Montenegro Business sector: Transport Project ID: 8032-IFT-40344 Funding source: EBRD and the client Type of contract: Supply and Install Type of notice: INVITATION FOR TENDERS Issue date: 20 October 2015 Closing date: 15 December 2015 12:00PM This Invitation for Tenders follows the General Procurement Notice for this Project which was published on the EBRD Web Site, Procurement Notice (<a target="_blank" href="http://www.ebrd.com" class="ojshref">www.ebrd.com</a>) on 14 May 2009 and further updated on 27 August 2010, 30 January 2012 and on 21 May 2015. The Montenegro Railway Infrastructure Company (ZICG) intends using the proceeds of a loan from the European Bank for Reconstruction and Development (“the Bank”) for a project to undertake emergency rehabilitation of the railway infrastructure. The Employer now invites sealed tenders from contractors for the following contract to be funded from part of the proceeds of the loan: Supply and Installation of Switch Heaters from catenary 25/0.22 KV for station Niksic and station Ostrog on Niksic - Podgorica Railway Line: • Supply, installation, testing and commissioning switch heaters for equipping Railway Station Niksic with supply from catenary, voltage 25/0.22 kV 50 Hz, • Supply, installation, testing and commissioning sub-stations TS 1 and TS 2 for securing switches and safety devices in station Niksic from catenary with voltage 25/0.22 kV 50 Hz, • Supply, installation, testing and commissioning switch heaters for equipping Railway Station Ostrog with supply from catenary, voltage 25/0.22 kV 50 Hz, • Supply, installation, testing and commissioning sub-stations TS for securing switches and safety devices in station Ostrog from catenary with voltage 25/0.22 kV 50 Hz, • Site infrastructure works and access facilities. The time completion for the Contract is 9 months. Tendering for contract to be financed with the proceeds of a loan from the Bank is open to firms from any country. To be qualified, a Tenderer must demonstrate to the Employer that it substantially satisfies the requirements regarding experience, personnel, equipment, financial position and litigation history, specified below: To be qualified for the award of the contract, tenderers must have the relevant licences for company and engineers, in accordance with the Montenegrin Regulation / Law on Arrangement of Space and Construction of Structures (Official Gazette of Montenegro no. 51/08, 34/11 i 35/13). If the Contractor does not have the licence for the execution of some kinds of works it is possible to hire a Subcontractor that has the appropriate licence. 1. Historical contract non-performance The Tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last five years. A consistent history of awards against the Tenderer or any partner of a joint venture may result in rejection of the tender. To facilitate the assessment of information the tenderers shall submit a summary of assets and liabilities, expressed in an equivalent of EUR converted based on the exchange rate reported as of the 1st of July of each year, as set by the central bank of Montenegro (CBCG). Based upon known commitments, the tenderers shall also provide a summary of the projected assets and liabilities for the next 2 years, 2015-2016, expressed in its equivalent of EUR converted based on the exchange rate as of the date of publication of the Invitation for Tenders, as set by the Central Bank of Montenegro (CBCG), unless the withholding of such information is justified by the tenderer to the satisfaction of the Client. 2. Financial Situation 2.1. Historical financial performance The audited balance sheets for the last five (5) years shall be submitted and must demonstrate the soundness of the Tenderer's financial position, showing long-term profitability. Where necessary, the Employer will make inquiries with the Tenderer's bankers. Consistent losses or a risk of insolvency shown in the accounts may cause for the disqualification of the tenderer. To facilitate the assessment of information the tenderers shall submit a summary of assets and liabilities, expressed in an equivalent of EUR converted based on the exchange rate reported as of the 1st of July of each year, as set by the central bank of Montenegro (CBCG). Based upon known commitments, the tenderers shall also provide a summary of the projected assets and liabilities for the next 2 years, 2015-2016, expressed in its equivalent of EUR converted based on the exchange rate as of the date of publication of the Invitation for Tenders, as set by the Central Bank of Montenegro (CBCG), unless the withholding of such information is justified by the tenderer to the satisfaction of the Client. 2.2. Average annual turnover Average annual turnover as prime contractor (defined as billing for works in progress and completed) over the last five (5) years of Euro One and half (1,5) million equivalent. 2.3. Financial resources The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 9 months, estimated as not less than Euro 450 000 equivalent, taking into account the Tenderer's commitments for other contracts. Current Obligations and Pending Awards: The tenderer shall have the abovementioned resources free of ongoing obligations and/or pending contract awards. The tenderer shall provide information on the ongoing contractual obligations and pending contract awards. The Client may reject the tender if the level of the confirmed commitments to be carried out in parallel with the Contract exceeds the tenderer’s annual turnover for the previous year by a factor of 1.2. 3. Experience The Tenderer shall meet the following minimum criteria: (a) General experience: successful experience as prime contractor in the execution of at least three projects of a nature and complexity comparable to the proposed contract that have been successfully and substantially completed within the last five (5) years. The similarity shall be based on the physical size, complexity, methods/technology or other characteristics as described in Volume III, The Employer’s Requirements. (b) Specific experience: (i) Proven experience in supply, installation and commissioning of 2 (Two) projects of switch heaters and sub-stations from catenary, voltage 25/0.22 kV 50 Hz for railway transport with a contractual price not less than 450 000 euros. (ii) The Tenderer is also required to demonstrate that it has previously performed those similar activities at paces comparable to the pace required to implement the project. 4. Personnel Capabilities. The Tenderer shall provide suitably qualified personnel to fill the following positions. To be qualified for the award of the contract, tenderers must have the relevant licences in accordance with the Montenegrin Regulation. Joint ventures must satisfy the following minimum qualification requirements: (a) The lead partner shall meet not less than 60 percent of all the qualifying criteria for general experience and financial position specified above. (b) The other partners shall meet not less than 40 percent of all the qualifying criteria for general experience and financial position specified above. The joint venture must satisfy collectively the criteria for personnel and equipment capabilities and financial position stated above, for which purpose the relevant figures for each of the partners shall be added to arrive at the joint venture's total capacity. Individual members must each satisfy the requirements for audited balance sheets and litigation.
